Hatice Cemre Akyilmaz

Cemre Akyılmaz graduated from Bilkent University, Faculty of Law in 2015. After graduation, she completed her legal internship and qualified as a lawyer in 2016.

In 2019, she got her master's degree at Gazi University, Institute of Social Sciences. Her master’s thesis was about the legislative power in constitutional law. In 2019, she started her doctoral studies at Ankara University. As of 2022, she continues her doctoral studies at Ankara Yıldırım Beyazıt University with her thesis titled "Positive Discrimination in Turkish Constitutional Law".

Akyılmaz worked as a research assistant at Anadolu University Faculty of Law, Department of Constitutional Law between 2018-2020. Since 2020, she has been working as a research assistant at Ankara Yıldırım Beyazıt University Faculty of Law, Department of Constitutional Law. She is also a lawyer in the Ankara Bar Association since 2016.

Akyılmaz was awarded a doctoral research fellowship by TÜBİTAK (The Scientific and Technological Research Council of Türkiye) and she is currently conducting her PhD studies as a visiting researcher at the University of Cologne, Academy for European Human Rights Protection.

Current research project

Exposé

The fundamental issue of the thesis on “Positive Discrimination on Turkish Constitutional Law” is the concept of positive discrimination. Positive discrimination refers to the privileges which are given to people who have some disadvantages in some areas of society, especially in the social, economic and political areas, because they have been exposed to discrimination in the past. The main aim of these privileges is to eliminate those disadvantages. In other words, the enactments of positive discrimination aim to eliminate “de facto discrimination” that occurs for various reasons. The main aim of the study is to find the historical and philosophical roots of the positive discrimination and to draw the theoretical framework of it by examining its relationship with the basic concepts of constitutional law, such as democracy, justice, and social state. Also, the positive discrimination does not mean giving unlimited privileges to the disadvantaged groups. The limits of positive discrimination is another research topic of this study. In addition, in this study, the effects of the enactment of positive discrimination will be discussed. While doing this, it will be examined whether the regulations in Turkish law are suitable for the fundamental aims of positive discrimination. If it is not, the reasons of this and the measures which should be taken will be determined by comparing with the regulations of international law and decisions of different constitutional courts.
